1. Who we are

Call to Remind is operated by [Legal Entity Name], a company / proprietorship registered in India, with its principal place of business at [Registered Address]. Where this document says “we”, “us”, or “Call to Remind”, it means that entity.

2. What you are agreeing to

By creating an account, recording a message, paying us, or otherwise using the service, you agree to these Terms of Use and to our Privacy Policy and Cancellation & Refund Policy.

If you do not agree, please do not use the service.

You confirm you are at least 18 years old and have the legal capacity to enter into this agreement.

3. Your account

You sign in using your phone number, verified via OTP. You are responsible for keeping the SIM and device that receives that OTP secure. Anyone with access to your verified phone number can access your account.

You may use the service only for yourself and for people who have agreed to receive reminder calls from you (typically a close family member).

4. What the service does

We place outbound phone calls to phone numbers you specify, at times you schedule, playing audio you have recorded. The call may also include simple options the recipient can use via the keypad (e.g. press 1 to confirm, 9 to stop calls).

The service is provided as a convenience reminder tool. It is not a medical alert system, an emergency notification system, or a substitute for professional medical or care services. It must not be relied upon for medication that, if missed, could cause serious harm. Always have an in-person care plan.

5. What you may not do

You agree you will not:

  • Use the service to call any phone number whose owner has not agreed to receive reminder calls from you.
  • Use the service for telemarketing, political messaging, religious messaging, debt collection, or any commercial outreach.
  • Use the service to harass, threaten, defame, or intimidate any person.
  • Impersonate any other person in a recording.
  • Upload recordings that contain unlawful content, sexually explicit content, hate speech, or content that infringes anyone’s rights.
  • Attempt to use the service to circumvent any do-not-call list, including India’s National Do Not Call Registry, for any purpose other than personal reminders to consenting family members.
  • Use any automation, scraper, or bot to access the service except through our official API (if and when we publish one).
  • Resell, sublicense, or commercialize the service without our written permission.

We may suspend or terminate any account that violates these rules without notice or refund.

6. Voice recordings — what you confirm

When you upload or record a voice message, you confirm:

  • The voice in the recording is your own, or that of a person who has given you permission to use it for this purpose.
  • The content is legal and not harmful to the recipient.
  • The recipient phone number belongs to a person who has agreed to receive the call from you.

You retain ownership of your recordings. You grant us a limited licence to store and transmit them to the recipient’s phone, only for the purpose of operating the service. We do not use them for AI training, public display, or any other purpose.

7. Payments and wallet

We charge in advance via a prepaid wallet. Wallet recharges are priced based on the caregiver’s country of residence (derived from phone number country code), with current tiers shown on the Pricing page.

Wallet balance is consumed when a call is placed and answered (or, for missed calls, on the final retry attempt as defined in the app). Unanswered retries are not charged.

Payments are processed by Razorpay (India) or Stripe (international). We do not store your card information.

Wallet balance does not expire while your account is active. Unused balance is governed by our Cancellation & Refund Policy.

GST or applicable sales tax, where required, is added at checkout and shown clearly before payment.

8. Service availability

We do our best to keep the service running but do not guarantee uninterrupted availability. Phone calls depend on third-party telephony networks (Twilio, Indian carriers, and the recipient’s carrier) that are outside our control. A call may be delayed, missed, marked as spam by the carrier, or fail to connect.

When a call fails to connect, we retry per the policy described in the app (typically up to 3 attempts within ~30 minutes). If all attempts fail, we notify you in the app and do not charge for that reminder.

9. Liability — your responsibility

You are responsible for the consequences of the recordings you upload and the calls you schedule. If your message is incorrect, mistimed, or causes the recipient to act incorrectly (for example, taking the wrong medication), the responsibility is yours, not ours. The service is a reminder tool, not a medical instruction system.

You agree to indemnify and hold us harmless against any third-party claim arising out of your misuse of the service, including but not limited to claims by recipients who did not consent to receive your calls.

10. Our liability to you

To the maximum extent permitted by Indian law:

  • The service is provided “as is”, without warranty of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or loss of goodwill.
  • Our total aggregate liability to you for any claim arising out of or related to the service is limited to the total amount you have paid us in the 12 months preceding the event giving rise to the claim, or ₹5,000, whichever is greater.

Nothing in these terms limits liability that cannot be limited under applicable Indian law (such as for death or personal injury caused by negligence, or for fraud).

11. Termination

You may terminate your account at any time from the app’s Settings screen. Refund of any unused wallet balance is governed by the Cancellation & Refund Policy.

We may terminate or suspend your account, without notice or refund, if you violate these Terms, if we are required to do so by law, or if your activity poses a risk to us, our vendors, or other users.

On termination, your reminders are stopped immediately and your data is deleted within the timeframes set out in the Privacy Policy.

12. Disputes and governing law

These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at [City, India — typically Bengaluru or your registered city].

Before approaching any court, both parties agree to attempt good-faith resolution by writing to hello@calltoremind.com with the subject “Dispute” and waiting 30 days for a response.
